The PopCap Social Networking Site Applications Privacy Policy

PopCap Games, Inc. is committed to making our social networking site applications ("SNS Apps") fun to use. We know that you care how information about you is used and shared. And if you're worried about your privacy it's hard to have a good time! That's why we work hard to protect your rights.

Please read the following Privacy Policy to understand how we use any information we may collect from you through our SNS Apps.

The Privacy Policy is current as of the effective date set forth above. We reserve the right to change this policy from time to time, so be sure to check back periodically. If the changes we make to our Privacy Policy are significant, we will notify you on this webpage that this Privacy Policy has been revised.

By using our SNS Apps, you agree that your personal information will be handled as described in this Privacy Policy, which is incorporated by reference into PopCap's Bejeweled Blitz Terms of Service.

It is your responsibility to read and accept the terms of service and privacy policy for the social networking sites you visit. We are not responsible for the privacy practices of other entities, including the social networking sites through which our SNS Apps are offered. This Privacy Policy applies solely to information collected by PopCap through our SNS Apps.

Information We Collect

Purchase Related Information

We receive and store the information you provide for any PopCap SNS App-related purchase or that you provide to us when you enter promotions or sweepstakes. This personal information, such as a valid e-mail address or credit card billing data, may be necessary to purchase virtual coins, access particular features, enter a promotion or sweepstakes, or otherwise transact business with us. You can choose not to provide certain information, but then you might not be able to take advantage of many of our premium features.

Other Personal Information

Other than purchase-related information, PopCap will not collect personal information directly from its SNS App users. At your discretion, however, you may choose to allow the relevant social networking site to provide your contact information such as your e-mail address and first and last name to PopCap.

Information We Collect Automatically

We receive and store certain types of information whenever you interact with us. For example, we automatically send and receive information to and from your computer which we use to automatically update (new features, bug fixes, etc.) our products and services that you may use. Like many websites, we also use "cookies," and other automated tools to obtain certain types of information when your Web browser accesses our SNS Apps. Though such information will typically be used in an aggregated way to improve our products and services, some information may be used to personalize your experience, or to offer you products and services specifically based on your preferences and usage.

Cookies

A cookie is a small text file recorded on your hard drive that identifies you as a unique user and contains certain information about your online activities.

PopCap sends "cookies" to your computer when you use one of our SNS Apps. The information we collect from cookies is used to identify you when you log in to play one of our SNS Apps from your social networking site profile, to improve the quality of our service and to make our SNS Apps more fun and easier to use.

The Help portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. However, you will not be able to use important features of our SNS Apps if you do not use cookies.

Other Sites

Our SNS Apps may contain links to other web sites and content which may be hosted by other web sites. In addition, the social networking site through which you accessed our SNS Apps or any content which frames our SNS Apps may be served by or hosted by other sites. These other sites maintain their own policies regarding cookies and the collection and use of personal information. It is up to you to review those policies yourself.

How We Use Your Information

When you use one of our SNS Apps on a social networking site, we may record information regarding the use of that SNS App, and we may collect other information that is visible on your social networking site in accordance with the relevant terms of use associated with that page. This information may include, but is not limited to, your name, profile picture, the pictures of your social networking site "friends", gender, and game scores. We will retain this information temporarily to enhance your experience when playing our games. For example, we may post the high scores and profile pictures of you and your friends while you play one of our SNS Apps.

We do not sell or rent your personal information to any third party, but we may disclose information about you to third parties acting on our behalf. These third parties may assist PopCap with processing payments, marketing, resolving service problems, and correcting errors related to the execution of its SNS Apps. However, we do not give these third parties an independent right to share or use your personal information.

How and When We Share Information

Information about our users is an important part of our business, and we are not in the business of selling it to others. We share customer information only as compatible with the purposes described above, when we have your permission or as described in this section.

• PopCap Subsidiaries: We may share your information with subsidiaries and affiliates that we own or control but only if those entities are either subject to this Privacy Policy or follow practices at least as protective as those described in this Privacy Policy.
• Contractors and Agents: We employ other companies and individuals to perform functions on our behalf. Examples include sending postal mail and e-mail, removing repetitive information from customer lists, analyzing data, providing marketing assistance (including data concerning marketing and promotional programs), processing credit card payments, providing customer service or for other purposes within the ordinary course of business. These third parties have access to the personal information needed to perform their functions on our behalf. We require these companies to agree (1) to provide adequate protections for your personal information that are no less protective than those set out in this Privacy Policy and (2) to use your personal information only for the purposes for which the third party has been engaged by us. We are not liable for the acts or omissions of these third parties, except as provided by applicable law.
• Jointly Offered Products and Services: From time to time we may offer products or services jointly with another entity, or may offer an additional product or service from another entity that in some way enhances or is related to a PopCap product or service. Examples include jointly developed, licensed or sponsored games, another entity's online service that is based upon a PopCap game, or products or services that may enhance your gaming or computing experience. In such cases, PopCap's use of your personal information is governed by this Privacy Policy, and the other entity's use of your personal information is governed by that entity's own privacy policy and/or terms of service.
• Business Transfers: As we continue to develop our business, we might sell or buy online stores, subsidiaries, or other businesses. In such transactions, customer information generally would be one of the transferred business assets but remains subject to the promises made in any pre-existing privacy policy (unless, of course, the customer consents otherwise). Also, in the event that PopCap, or substantially all of its assets are acquired, we will provide notice before customer information is transferred and becomes subject to a different privacy policy.
• Protection of PopCap and Others: We reserve the right to disclose your personal information when we believe release is appropriate to comply with the law, judicial proceeding, court order or other legal process; enforce or apply our Terms of Service and other agreements; or protect the rights, property, or safety of PopCap, our employees, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction purposes. This does not include selling, renting, sharing, or otherwise disclosing personal information from customers for commercial purposes in violation of this Privacy Policy.

How Secure Is Information About Me?

We take commercially reasonable precautions to protect your personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction.

We work to protect the security of your personal information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input such as payment card data.

We will not reveal or store more than the last four digits of your credit card number when you enter into a financial transaction through one of our SNS Apps. Of course, we transmit the entire credit card number to the appropriate credit card company for processing.

Please be aware that despite our best efforts, no data security measures can guarantee 100% security all of the time.

Any information we collect will be securely processed, stored and archived in databases and backups that could reside in either the United States and/or Ireland.

Can I Access My Personal Information?

We will take reasonable steps to ensure that the personal information we collect and store is reliable, accurate, complete and current. Please note, however, that we do not have control over the personal information you provide to your social networking site. You will need to contact them directly or log into your social networking site account to access or modify the personal information you provide to them.

Children Under The Age Of 13

PopCap does not knowingly collect or solicit personal information from anyone under the age of 13. If you are under 13, please do not attempt to send any information about yourself to us, including your name, address, telephone number, or e-mail address. In the event that we learn that we have collected personal information from a child under the age of 13 we will delete that information as quickly as possible.

Third-Party Advertising Companies

We may use third-party advertising companies to serve ads on our site and on certain PopCap games and SNS Apps. Our system and the third-party advertising technology uses information derived from cookies on your hard drive and the SNS Apps you use to target advertising within our SNS Apps. In addition, our advertisers may use other third-party advertising technology to target advertising on other sites. In the course of advertisements being served to you, a unique third-party cookie or cookies may be placed on your computer.

Similarly, third-party advertising companies may provide us with pixel tags (also called "clear gifs" or "beacons") to help manage and optimize our online advertising. Beacons enable us to recognize a browser's cookie when a browser visits the site on which the beacon is located, and to learn which banner ads bring users to a given site.

PopCap does not provide any personal information to third-party advertising companies. Note, however, that if an advertiser asks PopCap to show an advertisement to users with certain characteristics (for example, women ages 18-24) or a segment of that group (for example, women ages 18-24 who have viewed certain categories of content) and you respond to that advertisement, the third-party advertising company may conclude that you have the characteristics of the audience that they are trying to reach.

Terms of Service, Notices, and Revisions

If you choose to use our SNS Apps, any dispute over privacy is subject to this Privacy Policy and our Bejeweled Blitz Terms of Service, including applicable limitations on damages, arbitration of disputes, and application of the law of the state of Washington. If you have any concern about your privacy, please contact us with a thorough description or your question or concern, and we will try to resolve it.

Does PopCap Participate in the Safe Harbor Program?

PopCap is a participant in the Safe Harbor program developed by the U.S. Department of Commerce and the European Union. We have certified that we adhere to the Safe Harbor Privacy Principles agreed upon by the U.S. and the E.U. PopCap participates in the Council of Better Business Bureau's BBBOnLine Privacy Program. We have made a commitment to meet the program's strict requirements regarding how we treat your information and have it verified by BBBOnLine.
